These Terms and Conditions ("Terms") constitute a legally binding agreement between you and 5SecIn ("we," "us," or "our") governing your access to and use of the 5SecIn platform, including our website at www.5secin.com, related subdomains, and all associated services (collectively, the "Service").
By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
You must be at least 18 years old to create an Agent account. Visitors registering at open houses must be at least 16 years old. By using the Service, you represent and warrant that you meet the applicable age requirement and have the legal capacity to enter into these Terms.
To access certain features of the Service, you must create an account. When you create an account, you agree to:
Agent accounts are intended for individual use by a single real estate professional. You may not share your login credentials or allow unauthorized third parties to access your account.
5SecIn is a real estate open house visitor registration platform that enables Agents to:
5SecIn is a technology platform only. We are not a real estate brokerage, do not provide real estate advice, and are not responsible for the accuracy of property listings or the conduct of any Agent or Visitor.
The Service is offered in multiple tiers, including a free plan and paid subscription plans. Features, limits, and pricing for each plan are described on our website and may be updated from time to time.
We may offer free trials of paid features. At the end of a trial period, your account will revert to the free plan unless you subscribe to a paid plan. We will not charge you automatically at the end of a trial without your express consent.
Paid subscriptions are billed in advance on a recurring basis (monthly or annually, as selected). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account dashboard.
Subscription fees are generally non-refundable. If you cancel a paid subscription, you will continue to have access to paid features until the end of your current billing period.
We may change our subscription pricing from time to time. Any price changes will take effect at the start of the next billing period following notice to you. Your continued use of the Service after a price change constitutes your acceptance of the new pricing.
You agree not to use the Service to:
Violation of this Acceptable Use Policy may result in a warning, suspension, or termination of your account at our sole discretion. We reserve the right to report illegal activity to law enforcement authorities.
You retain all ownership rights in the User Content you upload to the Service, including property photos, listing information, documents, and profile information. By uploading User Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, store, display, reproduce, and process your User Content solely for the purpose of providing and improving the Service.
You represent and warrant that you own or have the necessary rights and permissions to upload all User Content, and that your User Content does not infringe any third-party intellectual property rights, violate any law, or breach any contractual obligation (including MLS rules or licensing agreements).
We may create aggregated, anonymized, or de-identified data derived from your use of the Service. Such data does not identify you or any individual Visitor and may be used by us for analytics, benchmarking, and service improvement without restriction.
You may export your data from the Service at any time through available export features. Upon account termination, you will have a 30-day window to export your data before it is permanently deleted.
When Visitors register at your open house through the Service, their Visitor Data is collected by the Service on your behalf and shared with you. As the Agent, you are the data controller for Visitor Data you receive, and 5SecIn acts as a data processor.
As an Agent, you agree to:
5SecIn is not responsible for how Agents use Visitor Data outside of the platform. Each Agent is independently responsible for their own compliance with applicable privacy and data protection laws.
The Service, including all software, design, text, graphics, logos, trademarks, and documentation, is the exclusive property of 5SecIn and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for its intended purpose and in accordance with these Terms. This license does not include the right to:
If you provide us with suggestions, feedback, or ideas regarding the Service, you grant us an unrestricted, irrevocable, worldwide, royalty-free right to use such feedback for any purpose without obligation or compensation to you.
By using the Service, you consent to receive transactional emails related to your account, such as registration confirmations, event follow-ups, lead notifications, and service announcements. These communications are essential to the operation of the Service and cannot be opted out of while your account is active.
If you opt in to receive SMS notifications (e.g., hot lead alerts), you agree to the following:
With your separate consent, we may send you marketing communications about new features, promotions, or other news. You may opt out of marketing emails at any time by clicking the unsubscribe link in any marketing email.
The Service integrates with and relies on third-party services, including but not limited to authentication providers (Clerk, Google, Apple), database and hosting services (Supabase, Vercel), email delivery (Resend), SMS delivery (Twilio), address autocomplete (Radar.io), and payment processing (Stripe).
We are not responsible for the availability, accuracy, performance, or security of any third-party service. Your use of features that rely on third-party services is subject to those providers' terms and conditions. We do not warrant that third-party services will be uninterrupted or error-free, and we shall not be liable for any loss or damage arising from third-party service outages, failures, or data breaches.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, disclose, and protect personal information. By using the Service, you acknowledge that you have read and understood our Privacy Policy.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
We make no representations or warranties regarding the accuracy, completeness, or reliability of any property listings, Visitor information, or other User Content on the Service. We are not responsible for verifying the identity, credentials, or licensing status of any Agent or the accuracy of any information provided by Visitors.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 5SECIN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO 5SECIN IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless 5SecIn and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
You may terminate your account at any time through your account settings or by contacting us at support@5secin.com. If you have a paid subscription, cancellation will take effect at the end of your current billing period.
We may suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:
Upon termination, your right to access the Service ceases immediately. You will have 30 days after termination to export your data. After this period, we may permanently delete your account data. The following sections of these Terms survive termination: User Content and Data Ownership, Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, and Governing Law.
Before initiating any formal dispute resolution, you agree to first contact us at support@5secin.com and attempt to resolve the dispute informally for at least 30 days.
If the dispute is not resolved informally, you and 5SecIn agree to resolve any claims relating to these Terms or the Service through final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration will be conducted on an individual basis, in English, and in the county where you reside or at another mutually agreed location.
YOU AND 5SECIN AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
Notwithstanding the above, either party may bring an individual action in small claims court for claims within that court's jurisdiction. Either party may also seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
You may opt out of the arbitration and class action waiver provisions by sending written notice to support@5secin.com within 30 days of creating your account. If you opt out, disputes will be resolved in the courts specified in the Governing Law section.
We respect the intellectual property rights of others. If you believe that content on the Service infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) to our designated copyright agent at support@5secin.com with the following information:
We will respond to valid DMCA notices by removing or disabling access to the allegedly infringing material. We may terminate the accounts of repeat infringers.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. For any disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.
We may update these Terms from time to time. When we make material changes, we will notify you by updating the "Last Updated" date at the top of this page and, where appropriate, by sending you an email or in-app notification at least 30 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
These Terms, together with the Privacy Policy and any other legal notices or agreements published by us on the Service, constitute the entire agreement between you and 5SecIn regarding the Service.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.
We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or telecommunications failures, power outages, or pandemics.
