5SecIn ("we," "us," or "our") operates the 5SecIn platform (the "Service"), a real estate open house visitor registration application accessible at www.5secin.com and related subdomains.

This Privacy Policy describes how we collect, use, disclose, and protect personal information when you use our Service, whether as a real estate agent ("Agent") managing open houses, a delegate acting on behalf of an Agent such as a hosting agent or associated partner (e.g., loan officer), or as a visitor ("Visitor") registering at an open house event.

By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy.

Important Note: This Privacy Policy applies to data collected and processed by 5SecIn. When Visitors register at an open house, their information is shared with the listing Agent. Each Agent is independently responsible for how they use Visitor data outside of the 5SecIn platform.

2. Information We Collect

A. Information You Provide Directly

Agent Account Information:

• Full name, email address, and phone number
• Professional details (real estate license number, brokerage name)
• Profile photo and branding images
• Website URL and public profile information (headline, bio)

Visitor Registration Information:

• Full name and email address (required)
• Phone number (optional)
• Qualification survey responses (buying/selling interests, purchase timeline, pre-approval status, whether you have an agent)
• Responses to custom questions set by the Agent

Property and Event Information (provided by Agents):

• Property details (address, listing information, photos, features, pricing)
• Event details (dates, times, descriptions)
• Property documents (PDFs uploaded for Visitor access)

Contact Submissions:

• Name, email, phone number (optional), company (optional), and message content submitted through our contact form

B. Information Collected Through Social Login

When you sign in using a social login provider (Google or Apple), we receive certain profile information from that provider, which may include your name, email address, and profile photo. Apple Sign In allows you to use an anonymized relay email address; in that case, we only receive the relay address you choose to share.

C. Information Collected Automatically

• Device and Usage Data: IP address, browser type, device type, operating system, pages visited, and timestamps
• Registration Metrics: Time to complete registration (to improve our sign-in experience)
• Activity Data: QR code scans, document downloads, document views, and page interactions
• Analytics Data: Page views, session information, and interaction data collected through our analytics providers

3. How We Use Your Information

We use the information we collect for the following purposes:

• Service Delivery: To provide, maintain, and improve the 5SecIn platform, including facilitating Visitor registration at open houses and delivering Visitor data to Agents
• Account Management: To create and manage Agent accounts, process subscriptions, and handle authentication
• Communications: To send transactional emails (registration confirmations, event follow-ups, lead alerts) and SMS notifications (hot lead alerts to Agents)
• Lead Management: To help Agents identify, score, and follow up with Visitors who register at their open houses
• Document Access: To provide Visitors with access to property documents shared by Agents
• Analytics and Improvement: To understand how the Service is used and to improve functionality and user experience
• Security: To detect and prevent fraud, abuse, and unauthorized access
• Legal Compliance: To comply with applicable laws, regulations, and legal processes

4. How We Share Your Information

With Agents (Visitor Data):

When a Visitor registers at an open house, their registration information (name, email, phone number, and qualification responses) is shared with the Agent hosting that event. Agents use this data to follow up with Visitors. 5SecIn does not control how Agents use Visitor data outside of the platform.

With Service Providers:

We share information with third-party service providers who perform services on our behalf, as described in the Third-Party Services section below. These providers are contractually obligated to use your information only for the purposes we specify.

For Legal Reasons:

We may disclose your information if required to do so by law, or if we believe in good faith that such action is necessary to comply with legal obligations, protect our rights or safety, or investigate potential violations of our terms.

We Do Not Sell Your Personal Information.

5SecIn does not sell, rent, or trade your personal information to third parties for their marketing purposes.

We use the following third-party services to operate the 5SecIn platform. Each processes data as described below:

6. Cookies and Tracking Technologies

We use the following types of cookies and tracking technologies:

• Essential Cookies: Required for authentication and session management (provided by Clerk). These cannot be disabled as they are necessary for the Service to function.
• Analytics Cookies: Used to understand how the Service is used, track page views, and measure performance (provided by PostHog and Vercel Analytics).

You can control cookies through your browser settings. Disabling essential cookies may prevent you from using certain features of the Service. We honor Global Privacy Control (GPC) signals where required by applicable law.

7. Data Retention

We retain your information for as long as necessary to provide the Service and fulfill the purposes described in this policy:

• Agent Account Data: Retained for the duration of your account, plus 30 days after account deletion to allow for reactivation.
• Visitor Registration Data: Retained while the associated Agent account is active. Deleted upon Agent account closure or upon a valid deletion request.
• Event and Property Data: Retained while the associated Agent account is active.
• Email and SMS Records: Retained for up to 3 years for compliance and deliverability tracking.
• Server Logs: Retained for up to 90 days for security monitoring.
• Payment Records: Retained as required by tax and financial regulations (typically 7 years).

When data is no longer needed, we delete or anonymize it in accordance with our data management procedures.

8. Data Security

We implement reasonable technical and organizational measures to protect your personal information, including:

• Encryption of data in transit (TLS/SSL)
• Row-level security in our database to isolate Agent data
• Signed, time-limited URLs for document access (7-day expiration)
• Token-based access controls for document downloads
• File type and size validation for all uploads
• Rate limiting on SMS and email sending

No method of transmission or storage is completely secure. While we strive to protect your information, we cannot guarantee absolute security.

9. Your Privacy Rights

Depending on your location, you may have the following rights regarding your personal information:

• Right to Access: Request a copy of the personal information we hold about you.
• Right to Correct: Request correction of inaccurate or incomplete personal information.
• Right to Delete: Request deletion of your personal information, subject to certain legal exceptions.
• Right to Opt Out: Opt out of the sale or sharing of your personal information (note: we do not sell personal information).

11. SMS/Text Messaging

If you are an Agent and opt in to receive SMS notifications, the following applies:

• We may send you automated text messages to notify you of hot leads registering at your open houses.
• Message frequency varies depending on your open house activity.
• Message and data rates may apply.
• You can opt out at any time by replying STOP to any message. Reply HELP for assistance.
• Consent to receive SMS is not a condition of purchasing or using the Service.
• SMS messages may include the Visitor's first name and phone number to enable real-time verification at the event.

We use Twilio to deliver SMS messages. Your phone number and message content are processed by Twilio in accordance with their Privacy Notice.

12. Children's Privacy

The Service is not directed to individuals under the age of 16. We do not knowingly collect personal information from children under 16. If we become aware that we have inadvertently collected personal information from a child under 16, we will take steps to delete that information promptly. If you believe we have collected information from a child under 16, please contact us at support@5secin.com.

13. International Users

The Service is operated in the United States. If you access the Service from outside the United States, please be aware that your information will be transferred to, stored, and processed in the United States. By using the Service, you consent to this transfer and processing.

14. Business Transfers

In the event of a merger, acquisition, reorganization, bankruptcy, or other similar event, your personal information may be transferred as part of that transaction. We will notify you of any such change and any choices you may have regarding your information.
